Background:  Personal service contracts and subcontracts with state agencies are subject to a state policy of open competition.  They can be subject to review by the Office of Financial Management (OFM) and the Joint Legislative Audit and Review Committee (JLARC), information about them is centralized for ease of public review, and proper accounting of personal service expenditures is assured.

State-funded personal service contracts of $10,000 or more are subject to competitive solicitation.  These contracts must be filed with OFM and JLARC and be made available for public inspection at least ten working days prior to the proposed starting date of the contract.

State-funded personal service contracts subject to competitive solicitation that provide services relating to management consulting, organizational development, marketing, communications, employee training, or employee recruiting must be reviewed and approved by OFM.

Summary of Substitute Bill:  State-funded personal service contracts subject to competitive solicitation that provide services relating to management consulting, organizational development, marketing, communications, employee training, or employee recruiting must be filed with OFM and JLARC, reviewed and approved by OFM and be made available for public inspection at least ten working days prior to the proposed starting date of the contract.  All other state-funded personal service contracts subject to competitive solicitation must be filed with OFM and JLARC and are effective no earlier than the date they are filed with OFM.
