Establishing criteria that limit school employees' ability to remove students from school.



    AN ACT Relating to removing a child from school grounds; and amending RCW 28A.605.010.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 28A.605.010 and 1975 1st ex.s. c 248 s 1 are each amended to read as follows:

    The board of directors of each school district by rule or regulation shall set forth proper procedure to ensure that each school within their district is carrying out district policy providing that no child will be removed from any school grounds or building thereon during school hours except by a person so authorized by a parent or legal guardian having legal custody thereof((:  PROVIDED, That such rules and regulations need not be applicable to any child in grades nine through twelve)).  Such rules shall be applicable to school employees who may not remove students from school grounds without parent authorization unless the employee is the student's parent or immediate family member; a classified staff member providing school bus transportation services in accordance with chapter 28A.160 RCW; a certificated staff member supervising an extracurricular activity in which the student is participating and the employee is providing transportation to or from the activity; or the student is in need of immediate medical attention, without which the life of the student may be endangered, and the employee is unable to reach the parent for transportation of the student.
