Requiring state agency personal service contracts to specify that the state owns the data generated under the contracts.



    AN ACT Relating to personal service contracts; and adding a new section to chapter 39.29 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 39.29 RCW to read as follows:

    Agency contracts with consultants for personal services shall specify that the state owns all of the data generated under the contract and that the state shall take possession of or have reasonable access to this data.  Such data shall include all information that supports the findings, conclusions, and recommendations of the consultant's reports including computer models and the methodology and assumptions of such models.  The office of financial management may grant exceptions to the requirements of this section upon its approval of a written request by the agency setting forth why the exception is in the best interest of the state.  The office of financial management shall develop criteria for granting exceptions to this section.
