AN ACT Relating to construction of certain highway projects under a design-build procedure; creating new sections; and making an appropriation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. The legislature finds and declares that a contracting procedure that facilitates construction of transportation facilities in a more timely and efficient manner is needed to ensure that construction can proceed simultaneously with the design of the facility.
NEW SECTION. Sec. 2. The department of transportation shall develop, by January 1, 1998, a process for awarding competitively bid highway construction contracts for projects that may be constructed using a design-build procedure. As used in this section, "design-build procedure" means a method of contracting under which the department of transportation contracts with another party for such party to both design and build the structures, facilities, and other items specified in the contract.
The process developed by the department shall, at a minimum, include the scope of services required under the design-build procedure, contractor prequalification requirements, criteria for evaluating technical information and project costs, contractor selection criteria, and an issue resolution procedure.
A one-project demonstration program that uses the design-build method of contracting, as prescribed under a process developed by the department, is established and shall be implemented under a competitively bid contract to construct two additional lanes on that portion of state route number 522 from Paradise Lake Road to the Snohomish River bridge, beginning at mile post 17.46 and ending at mile post 20.50, including interchanges at Paradise Lake Road and Fales/Echo Lake Road.
NEW SECTION. Sec. 3. The sum of seven million nine hundred thousand dollars, or as much thereof as may be necessary, is appropriated from the motor vehicle fund to the department of transportation for the fiscal year ending June 30, 1999, for the construction of two additional lanes on state route number 522 from state route number 9 to Paradise Lake Road, beginning at mile post 14.09 and ending at mile post 17.46.
NEW SECTION. Sec. 4. If this act is not referred to by bill or chapter number in a transportation budget, or an omnibus appropriations act, that, by December 31, 1997, either becomes law under Article III, section 12 of the state Constitution or is approved by the people of this state, this act is null and void on December 31, 1997.
