Establishing the adult family home disciplinary board.


    AN ACT Relating to the adult family home disciplinary board; and adding new sections to chapter 18.48 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  The Washington state adult family home disciplinary board is established, consisting of five members each appointed by the governor for a three-year term.  A member may not serve more than two consecutive full terms.  Members of the board shall continue to serve until their successors are appointed.  For the purposes of continuity, the governor may appoint members of the initial board to staggered terms of from one to three-year terms.  Thereafter, all members shall be appointed to full three-year terms.  The board shall act as the disciplining authority for providers and resident managers registered with the department under this chapter, and may upon request respond in an advisory capacity to questions raised regarding the care and treatment of residents of adult family homes licensed by the department of social and health services or its successor.

 

    NEW SECTION.  Sec. 2.  Members of the board must be residents of the state, registered with the department as adult family home providers or resident managers.  Four members of the board shall represent developmentally disabled family homes, elderly adult family home providers, adult family homes for the mentally challenged, and multiple adult family home providers, respectively.  One member shall represent the public who is experienced in adult family home advocacy and may not be a member of any other health care licensing authority, or have a fiduciary obligation to an adult family home provider or resident manager regulated by the board.

 

    NEW SECTION.  Sec. 3.  The governor may remove a member for cause as specified by rules promulgated by the secretary.  The adult family home disciplinary board shall meet at the request of the secretary as necessary.  The board may elect a presiding chair and vice-chair from among the members.

 

    NEW SECTION.  Sec. 4.  Each member will be reimbursed for travel expenses as authorized in RCW 43.03.050 and 43.03.060.  In addition, members will be compensated in accordance with RCW 43.03.240 when engaged in the authorized business of the board.

 

    NEW SECTION.  Sec. 5.  The governor, members of the board, or individuals acting on their behalf are immune from suit in a civil action based on any disciplinary proceedings or other official acts performed in the course of their duties.

 

    NEW SECTION.  Sec. 6.  Sections 1 through 5 of this act are each added to chapter 18.48 RCW.
