Using sales and use tax revenues from railroads for noise abatement and safety purposes.


    AN ACT Relating to using sales and use tax revenues generated for rail transportation expansion for noise abatement and safety purposes; adding a new section to chapter 82.32 RCW; and adding a new chapter to Title 47 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 82.32 RCW to read as follows:

    The department of revenue shall deposit into the railroad noise abatement and safety account created in section 2 of this act all moneys received from the imposition of the taxes under chapters 82.08 and 82.12 RCW on the charge made for labor and services rendered and property purchased or used in respect to the building, repairing, rehabilitating, improving, maintaining, or expanding of rail transportation rights of way, tracks, signals, bridges, tunnels, trestles, or facilities, including switching yards, terminals, and the sites of those facilities, and the sales and use of fuel for use in rail transportation.

 

    NEW SECTION.  Sec. 2.  (1) The railroad noise abatement and safety account is created in the custody of the state treasurer.  All receipts from section 1 of this act must be deposited into the account.  Expenditures from the account may be used only for the purposes of subsection (2) of this section.  Only the secretary or the secretary's designee may authorize expenditures from the account.  The account is subject to allotment procedures under chapter 43.88 RCW, but an appropriation is not required for expenditures.

    (2) The department shall distribute moneys in the railroad noise abatement account to local jurisdictions for the purpose of railroad noise abatement and safety.  A local jurisdiction may apply to the department for moneys in an amount equal to the amount of moneys deposited into the railroad noise abatement and safety account under section 1 of this act that were generated from activities or use within the local jurisdiction, for projects designed to abate noise and increase safety related to railroad activities in the local jurisdiction.  The department shall evaluate the applications and fund projects that carry out the purposes of this subsection.

    (3) The department shall adopt rules to implement this section.

 

    NEW SECTION.  Sec. 3.  Section 2 of this act constitutes a new chapter in Title 47 RCW.
