AN ACT Relating to associations of local governments; adding a new section to chapter 42.17 RCW; adding a new section to chapter 27.12 RCW; adding a new section to chapter 28A.320 RCW; adding a new section to chapter 35.21 RCW; adding a new section to chapter 36.32 RCW; adding a new section to chapter 52.12 RCW; adding a new section to chapter 53.06 RCW; adding a new section to chapter 54.16 RCW; adding a new section to chapter 57.08 RCW; and adding a new section to chapter 87.76 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1. A new section is added to chapter 42.17 RCW to read as follows:

(1) A local government may not pay membership dues or provide compensation to a private entity for local government association purposes if the total amount of dues or compensation paid to the private entity by local governments, including interest earned on investment of such dues or compensation, constitutes two-thirds or more of the gross revenues of the private entity, unless, as a condition of receipt of the dues or compensation, the private entity agrees to the following conditions:

(a) The private entity submits to a periodic audit by the state auditor, as if the private entity were a local government;

(b) The records of the private entity are made available to the public for inspection and copying under the provisions of this chapter, as if the records were public records and the entity were a local government;

(c) Meetings of the board of directors or any committee of the board of directors are open to the public under the provisions of chapter 42.30 RCW, as if the private entity were a public agency and the board of directors were a governing body; and

(d) The funds of the private entity and its facilities may not be used for campaign purposes under the provisions of RCW 42.17.130, as if the private entity were a local government.

(2) Unless the context clearly requires otherwise, the definitions in this subsection apply throughout this section.

(a) "Association purposes" means the coordination of administrative programs, preparation of annual reports, furnishing information to the legislature and governor, acting as a coordinating agency, promoting the efficient operations of local governments, submitting reports and recommendations, and communicating with the legislature and state agencies on positions of, and requests by, members, whether the members are units of local government or elected or appointed officials of units of local government.

(b) "Local government" means a county, city, town, port district, school district, irrigation district, fire protection district, public utility district, or any other municipal or quasi-municipal corporation.

NEW SECTION. Sec. 2. A new section is added to chapter 27.12 RCW to read as follows:

Library districts are subject to section 1 of this act.

NEW SECTION. Sec. 3. A new section is added to chapter 28A.320 RCW to read as follows:

School districts are subject to section 1 of this act.

NEW SECTION. Sec. 4. A new section is added to chapter 35.21 RCW to read as follows:

Cities and towns, including code cities, are subject to section 1 of this act.

NEW SECTION. Sec. 5. A new section is added to chapter 36.32 RCW to read as follows:

Counties are subject to section 1 of this act.

NEW SECTION. Sec. 6. A new section is added to chapter 52.12 RCW to read as follows:

Fire protection districts are subject to section 1 of this act.

NEW SECTION. Sec. 7. A new section is added to chapter 53.06 RCW to read as follows:

Port districts are subject to section 1 of this act.

NEW SECTION. Sec. 8. A new section is added to chapter 54.16 RCW to read as follows:

Public utility districts are subject to section 1 of this act.

NEW SECTION. Sec. 9. A new section is added to chapter 57.08 RCW to read as follows:

Water-sewer districts are subject to section 1 of this act.

NEW SECTION. Sec. 10. A new section is added to chapter 87.76 RCW to read as follows:

Irrigation districts are subject to section 1 of this act.
