Receiving tobacco settlement money.


    AN ACT Relating to designation of tobacco settlement receipts; and adding a new section to chapter 43.79 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 43.79 RCW to read as follows:

    (1) In any legal action, or settlement thereof, by the state of Washington to recover moneys expended by the state for the tobacco-related health care costs of state residents, and to the maximum extent permitted by court order, negotiated settlement, or federal law, the proceeds received by the state shall be subject to legislative appropriation and shall be deposited to the health services account established by RCW 43.72.900.

    (2) In any legal action, or settlement thereof, by the state of Washington to recover moneys expended by the state for the tobacco-related health care costs of state residents, the attorney general shall seek a legal resolution of the action that is consistent with and maximizes the effect of subsection (1) of this section.

 

    NEW SECTION.  Sec. 2.  If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
