AN ACT Relating to the sale of the Tacoma armory; amending 1967 c 224 s 1 (uncodified); amending 1967 c 224 s 2 (uncodified); creating a new section; repealing 1967 c 224 s 3 (uncodified); and providing an expiration date.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. 1967 c 224 s 1 (uncodified) is amended to read as follows:
The
Washington state military department is ((hereby)) authorized to sell ((,
lease or exchange)) to the city of Tacoma or Pierce county, state of
Washington, the present state armory land and buildings in the city of Tacoma,
at 715 South 11th Street legally described as Lots 1 through 12, Block 1015,
Plat of New Tacoma, Pierce county, Washington, ((which)) for the
purpose of public safety, emergency management, or judicial branch activities.
The sale((, lease or exchange)) shall be by and under the direction
of the ((adjutant general in accordance with the procedures provided by
law: PROVIDED, That in the opinion of the adjutant general the appraised value
of said land and buildings is in a sum which together with other funds
available to the state military department will provide sufficient funds for
the purchase of real property and the construction of a new armory or armories))
department of general administration.
((Before
any sale under the provisions of this act shall be made the property shall be
appraised by two independent competent real estate appraisers.)) Any sale
pursuant to the provisions of sections 1 and 2 of this act shall be made
to the ((best)) highest bidder for a price not less than ((the
appraised value of said property and pursuant to a call for bids published at
least fifteen days prior to the date fixed for the sale in one issue of a
newspaper printed and published in the county in which the armory is located))
one million five hundred thousand dollars.
The
proceeds of the sale ((or exchange)) of ((said)) the
property shall be transmitted by the ((adjutant general)) department
of general administration to the state treasurer((. In the event the
armory is leased the proceeds of such lease shall be deposited as revenue to
the armory fund of the military department)) to be held in the state
building construction account for the purpose of a new armory or armories.
Sec. 2. 1967 c 224 s 2 (uncodified) is amended to read as follows:
Upon
the sale ((or exchange)) of the property described in section 1 of this
act, the state military department may select a site or sites for a new
armory or armories in Pierce county to enhance the emergency management
capabilities of the county and may acquire lands and buildings or acquire
lands and construct new buildings for such purpose and may furnish and equip
such buildings for military purposes.
NEW SECTION. Sec. 3. If the land and buildings described in section 1 of this act, once purchased by the city or county, are used for any purpose other than public safety, emergency management, or judicial branch activities, ownership of the land and property reverts back to the state.
NEW SECTION. Sec. 4. 1967 c 224 s 3 (uncodified) is repealed.
NEW SECTION. Sec. 5. This act expires July 1, 2001.
