Funding the mitigation of highway noise, water pollution, and fish passage barriers.


    AN ACT Relating to mitigation of highway noise, water pollution, and fish passage barriers; and amending RCW 47.12.125.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 47.12.125 and 1991 c 291 s 3 are each amended to read as follows:

    All moneys paid to the state of Washington under any of the provisions of RCW 47.12.120 shall be deposited in the following manner:  (1) One-half in the department's advance right of way revolving fund; and (2) one-half in the motor vehicle fund to be used only for retrofit projects for mitigation of noise, water pollution, and fish passage impacts, except moneys that are subject to federal aid reimbursement, which shall be deposited in the motor vehicle fund((, and except that moneys received from rental of capital facilities properties shall be deposited in the transportation capital facilities account as defined in chapter 47.13 RCW)) are not subject to the mitigation restrictions.  The department may spend up to one-half of moneys subject to federal reimbursement on cost-shared projects mitigating the noise, water pollution, and fish passage barriers of existing highways.
