Creating a committee to develop an airport glycol use plan.


    AN ACT Relating to the use of glycols; creating new sections; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  The legislature finds it is essential to protect and enhance the quality of Washington's water resources.  The legislature finds that the state must ensure adequate protection of the environment, including aquifers and surface water sources that supply public drinking water and help sustain aquatic life and habitat.  The protection of wetlands, lakes, rivers, creeks, and the Puget Sound that provide critical fish and wildlife habitat, and enhance our quality of life, must remain a high priority.

    Sources of human-caused pollution must be identified and addressed to reduce or eliminate water quality degradation.  One such source of human-caused pollution is the use of ethylene and propylene glycols as aircraft de-icers at major airports.  The legislature finds that airports within the state must implement all known and reasonable techniques to eliminate the discharge of glycols to surrounding surface and ground waters.

 

    NEW SECTION.  Sec. 2.  (1) A committee to develop a Washington state airport glycol use plan is created.  The committee shall consist of up to two senate members from each of the two largest caucuses of the senate, selected by the president of the senate and up to two representatives from each of the two largest caucuses of the house of representatives, selected by the speaker of the house of representatives.  Staff support for the committee shall be provided by the office of program research in the house of representatives and by senate committee services.

    The committee shall submit a plan with statutory recommendations, if any, to the legislature by January 1, 1999.

    (2) The committee may create advisory groups to assist it in  evaluating these issues and shall consult with the following:

    (a) Citizens interested in water quality and protecting and enhancing fish and wildlife habitat;

    (b) The director or the director's designee from the departments of fish and wildlife, health, ecology, natural resources, and agriculture;

    (c) County governments, port districts, water-sewer districts, local health departments, and cities; and

    (d) Scientific and academic specialists.

    (3) The glycol use plan shall include a review of all airports serving an annual daily average of more than one thousand scheduled commercial passenger flights.  The plan shall include, but not be limited to, the following elements:

    (a) An overview of the science of glycols, its usage as an aircraft de-icer and its potential to contaminate the waters of the state.  This scientific overview should identify and critically evaluate the various methods and techniques available for application of glycols on aircraft;

    (b) An assessment of, and recommendations addressing, the problems associated with the capture and on-site treatment of glycols;

    (c) Recommendations on sources of federal, state, and local funding for developing management programs and projects to protect state waters from glycols; and

    (d) A plan or program to provide public information and education concerning the effectiveness of glycols as a de-icer and the methods available to prevent glycols from polluting surface and ground waters.

 

    NEW SECTION.  Sec. 3.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and takes effect immediately.
