Permitting individuals to bring food or food items into stadiums.


    AN ACT Relating to permitting individuals to bring food or food items into stadiums; and amending RCW 36.100.030 and 36.102.050.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 36.100.030 and 1995 1st sp.s. c 14 s 3 are each amended to read as follows:

    (1) A public facilities district is authorized to acquire, construct, own, remodel, maintain, equip, reequip, repair, and operate sports facilities, entertainment facilities, or convention facilities, or any combination of such facilities, together with contiguous parking facilities.  The taxes that are provided for in this chapter may only be imposed for these purposes.

    (2)(a) A public facilities district may enter into agreements under chapter 39.34 RCW for the joint provision and operation of such facilities and may enter into contracts under chapter 39.34 RCW where any party to the contract provides and operates such facilities for the other party or parties to the contract.

    (b) An agreement entered into under (a) of this subsection must contain provisions that allow individuals attending events at the stadium to bring food or food items for consumption inside the stadium.

    (c) The agreement must prohibit an individual from bringing food or food items in glass bottles, cans, picnic baskets, bota bags, ice chests, and thermoses in excess of two-quart capacity, into the stadium.  Individuals possessing such items may not be admitted to, or must be removed from the stadium until the items have been stored temporarily at locations provided for that purpose or disposed of in some other manner.  As used in this subsection, "food or food items" does not include alcoholic beverages of any type.  As used in this subsection, "stadium" means a "baseball stadium" as defined in RCW 82.14.0485.

    (3) Notwithstanding the establishment of a career, civil, or merit service system, a public ((facility [facilities])) facilities district may contract with a public or private entity for the operation or management of its public facilities.

    (4) A public facilities district is authorized to use the supplemental alternative public works contracting procedures set forth in chapter 39.10 RCW in connection with the design, construction, reconstruction, remodel, or alteration of any of its public facilities.

    (5) A public facilities district may impose charges and fees for the use of its facilities, and may accept and expend or use gifts, grants, and donations.

 

    Sec. 2.  RCW 36.102.050 and 1997 c 220 s 105 (Referendum Bill No. 48) are each amended to read as follows:

    (1) The public stadium authority is authorized to acquire, construct, own, remodel, maintain, equip, reequip, repair, and operate a stadium and exhibition center as defined in RCW 36.102.010.

    (2)(a) The public stadium authority may enter into agreements under chapter 39.34 RCW for the joint provision and operation of a stadium and exhibition center and may enter into contracts under chapter 39.34 RCW where any party to the contract provides and operates the stadium and exhibition center for the other party or parties to the contract.

    (b) An agreement entered into under (a) of this subsection must contain provisions that allow individuals attending events at the stadium and exhibition center to bring food or food items for consumption inside the stadium and exhibition center.

    (c) The agreement must prohibit an individual from bringing food or food items in glass bottles, cans, picnic baskets, bota bags, ice chests, and thermoses in excess of two-quart capacity, into the stadium and exhibition center.   Individuals possessing such items may not be admitted to, or must be removed from the stadium and exhibition center until the items have been stored temporarily at locations provided for that purpose or disposed of in some other manner.  As used in this subsection, "food or food items" does not include alcoholic beverages of any type.

    (3) Any employees of the public stadium authority shall be unclassified employees not subject to the provisions of chapter 41.06 RCW and a public stadium authority may contract with a public or private entity for the operation or management of the stadium and exhibition center.

    (4) The public stadium authority is authorized to use the alternative supplemental public works contracting procedures set forth in chapter 39.10 RCW in connection with the design, construction, reconstruction, remodel, or alteration of a stadium and exhibition center.

    (5) The public stadium authority may impose charges and fees for the use of the stadium and exhibition center, and may accept and expend or use gifts, grants, and donations.

    (6) The public stadium authority shall comply with the prevailing wage requirements of chapter 39.12 RCW and goals established for women and minority-business participation for the county.
