Regarding disclosure of job-related information.

    AN ACT Relating to disclosure of employee information; and adding a new section to chapter 49.12 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 49.12 RCW to read as follows:

    An employer may disclose to a prospective employer job-related information about a former or current employee's job performance or conduct.  An employer shall be civilly liable for the disclosure of such information only upon a showing by clear, cogent, and convincing evidence that the employer knew the information was false or had a reckless disregard for the truth of the information.  Nothing in this section shall affect or limit any other right otherwise available.
