Transferring membership into the law enforcement officers' and fire fighters' retirement system, plan I.


    AN ACT Relating to transferring membership into the law enforcement officers' and fire fighters' retirement system, plan I; creating a new section; and providing an expiration date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  If a member of the law enforcement officers' and fire fighters' retirement system, plan II was an elected sheriff or an appointed police chief or fire chief on September 30, 1977, and was denied membership in the law enforcement officers' and fire fighters' retirement system, plan I solely because the member did not meet the age standard in effect at that time, and the member has served continuously as a law enforcement officer or fire fighter since that time and the member is still employed as such, the member shall have the option to transfer his or her membership to plan I.  The department shall transfer the membership to plan I as if the member had been a member of plan I since the member's date of election or appointment, provided that the member pays to the plan, on or before December 31, 1998, an amount equal to the employee's and employer's contributions that would have been required when the member's service was rendered, together with interest as required by the director.  The member's prior service as a law enforcement officer or fire fighter shall be creditable under plan I, and the membership in plan I shall be retroactive to the date of election or appointment.  Any benefits payable under plan I shall commence prospectively from the date the member has paid the outstanding contributions.  This section expires December 31, 1998.

 

    NEW SECTION.  Sec. 2.  Section 1 of this act is added to chapter 41.26 RCW under subchapter heading "Plan II", but because of its temporary nature, shall not be codified.
