Regulating use activities.



    AN ACT Relating to shoreline management; adding a new section to chapter 90.58 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 90.58 RCW to read as follows:

    No master program may prohibit or unreasonably regulate a use activity under the guidelines if the use activity meets the following conditions as designated in the guidelines:

    (1) Is a preferred water-dependent use;

    (2) Has state-wide and national interest;

    (3) Can result in long-term over short-term benefits if properly managed;

    (4) Can protect the resources and ecology of the shoreline if properly managed;

    (5) Is conditional on an environmental designation under the guidelines that permit the use activity outright or by a conditional use.

 

    NEW SECTION.  Sec. 2.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and takes effect immediately.
