Requiring replacement transportation when a claimant's vehicle is totaled.


    AN ACT Relating to insurer provision of replacement transportation when a claimant's vehicle is totaled; and adding a new section to chapter 48.22 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 48.22 RCW to read as follows:

    In any claim situation, where its insured is liable to a third party claimant, the insurer shall make a good faith effort to provide temporary replacement transportation to a third party claimant whose vehicle is a total loss.  This benefit shall be payable from the date of loss and end within a reasonable period of time not less than seven days after the company has made a reasonable good faith offer to settle or when the insured has purchased a replacement vehicle, whichever comes first.
