Authorizing development regulations governing vegetation height.

    AN ACT Relating to development regulations governing vegetation height; and adding a new section to chapter 36.70 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 36.70 RCW to read as follows:

    Each city or county may adopt development regulations governing the height of vegetation in areas the city or county has determined to be view-sensitive based upon local valuations and assessments.  Vegetation height restrictions must be consistent with height limits on structures in the area and the character of the neighborhood.  Each city or county may also implement incentive programs to remedy nonconforming heights of existing vegetation.
