Providing strict liability for the sale of cigarettes and tobacco products.

    AN ACT Relating to actions for harm caused by cigarettes or tobacco products; and adding a new section to chapter 4.24 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 4.24 RCW to read as follows:

    (1) A retailer or wholesaler of cigarettes or a distributor or retailer of tobacco products is strictly liable for harm proximately caused by the product.

    (2) The definitions in RCW 82.24.010 and 82.26.010 apply to this section.
