Requiring salmon eggs to be utilized in the cultivation of salmon.


    AN ACT Relating to sale of salmon eggs; adding a new section to chapter 75.08 RCW; and repealing RCW 75.08.245.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 75.08 RCW to read as follows:

    The depleted nature of salmon and steelhead trout stocks within the state, the 1997 listing under the federal endangered species act of upriver Columbia river steelhead trout, and the potential listing of salmon as endangered species under the federal endangered species act, require that all eggs be utilized for the restoration of salmon and steelhead trout stocks.  The department shall utilize all salmon and steelhead trout eggs within the department's possession for the purpose of salmon and steelhead trout population rehabilitation and enhancement for both state and tribal fisheries.  The department is strictly prohibited from selling or transferring to any other entity salmon or steelhead trout eggs or females containing eggs if the eggs are not to be utilized for rehabilitation and enhancement.

 

    NEW SECTION.  Sec. 2.  RCW 75.08.245 and 1988 c 115 s 1, 1983 1st ex.s. c 46 s 25, 1974 ex.s. c 23 s 1, & 1971 c 35 s 4 are each repealed.
