Providing immunity from civil liability for provision of probation services.

    AN ACT Relating to probation services; and adding a new section to chapter 9.95 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 9.95 RCW to read as follows:

    If a county engages in probation services under RCW 36.01.070 or a city engages in probation services, neither the county or city or its probation department employees, or volunteers who assist probation officers in supervising or monitoring offenders, are liable for civil damages resulting from any act or omission in providing probation services unless the act or omission is the result of an employee maliciously or intentionally misusing his or her authority and is outside the scope of his or her position.
