Allowing a holder of perpetual timber rights to sign a statement of intent not to convert the land to other uses for a period of time.


    AN ACT Relating to perpetual timber rights; and adding a new section to chapter 76.09 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 76.09 RCW to read as follows:

    For the purposes of RCW 76.09.060(3)(b)(i)(A), RCW 76.09.065(2)(a), and Class IV forest practices under RCW 76.09.050(1) in the case of an application on forest lands where the timber rights have been transferred by deed to a perpetual owner who is different from the landowner, the owner of perpetual timber rights may sign the statement of intent not to convert to a use other than commercial forest product operations for a set period of time, and that statement shall be deemed binding on the landowner.  Together with the appropriate forest practices application, the holder of perpetual timber rights shall submit evidence that the signed statement of intent has been served on the landowner.
