Ordering the department of social and health services to establish allowances for specified items for persons receiving specified services.


    AN ACT Relating to clothing, personal maintenance, and incidental allowances within the department of social and health services; adding a new section to chapter 74.08 RCW; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 74.08 RCW to read as follows:

    To the extent allowed by federal law, the department:

    (1) Shall establish a uniform monthly allowance for clothing, personal maintenance, and necessary incidentals for all individuals residing in state-funded residential facility beds.  The allowance shall be set no lower than the highest allowance currently authorized on the effective date of this act.  The department shall not remove any individual from any program based on a change in his or her income or resources attributable to the modification of the uniform monthly allowance mandated under this section;

    (2) Shall increase the uniform monthly allowance set under this section by the same rate as authorized for any vendor rate increase for state-funded residential facilities;

    (3) May adjust an individual's uniform monthly allowance, by agreement with the individual, if the allowance would effect his or her eligibility to receive services under medicaid personal care, the community options program entry system, or any other program providing state-funded residential facilities.

 

    NEW SECTION.  Sec. 2.  This act takes effect July 1, 1998.
