Providing an annual cost-of-living allowance.


    AN ACT Relating to an annual cost-of-living allowance for state employees; adding a new section to chapter 28A.400 RCW; adding a new section to chapter 28B.10 RCW; and adding a new section to chapter 41.04 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 28A.400 RCW to read as follows:

    (1)(a) Beginning with the 1998-1999 school year, and for each subsequent school year, the legislature shall fund, in an omnibus appropriation bill under RCW 43.88.080, as a minimum increase, an annual cost-of-living allowance for the salaries and salary-related statutory benefits of all school district certificated and classified staff.

    (b) The annual cost-of-living allowance granted under (a) of this subsection is a percentage increase of no less than the previous year's percentage increase in the consumer price index, CPI-U, for Seattle as published by the United States department of labor, bureau of labor statistics applied to that year's legislative evaluation and accountability program (LEAP) document 12D salary.  A decrease in the consumer price index is not applied.

    (c) The cost-of-living allowance for the 1998-99 school year is applied to the 1997-98 school year's legislative evaluation and accountability program (LEAP) document 12D salary.

    (2) If for any reason an omnibus appropriation bill or supplemental appropriation bill is not enacted, any annual cost-of-living allowance not funded by the legislature shall be calculated and included in the derived base salary for the purpose of calculating the annual increase for inclusion in the next enacted omnibus appropriation bill.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 28B.10 RCW to read as follows:

    (1)(a) Beginning July 1, 1998, and for each subsequent year, the legislature shall fund, in an omnibus appropriation bill under RCW 43.88.080, as a minimum increase, an annual cost-of-living allowance for the salaries and salary-related statutory benefits of all faculty at institutions of higher education.

    (b) The annual cost-of-living allowance granted under (a) of this subsection is a percentage increase of no less than the previous year's percentage increase in the consumer price index, CPI-U, for Seattle as published by the United States department of labor, bureau of labor statistics applied to that year's salary schedule as determined under chapter 41.06 or 41.56 RCW.  A decrease in the consumer price index is not applied.

    (c) The cost-of-living allowance for the year beginning July 1, 1998, is applied to the salary schedule in place on June 30, 1998.

    (2) If for any reason an omnibus appropriation bill or supplemental appropriation bill is not enacted, any annual cost-of-living allowance not funded by the legislature shall be calculated and included in the base salary for the purpose of calculating the annual increase for inclusion in the next enacted omnibus appropriation bill.

 

    NEW SECTION.  Sec. 3.  A new section is added to chapter 41.04 RCW to read as follows:

    (1)(a) Beginning July 1, 1998, and for each subsequent year, the legislature shall fund, in an omnibus appropriation bill under RCW 43.88.080, as a minimum increase, an annual cost-of-living allowance for the salaries and salary-related statutory benefits of all state employees, as follows:  General government, legislative, judicial, and classified employees; Washington management service employees, exempt employees under the Washington personnel resources board; and employees exempt from merit system rules whose salaries are not set by the commission on salaries for elected officials.

    (b) The annual cost-of-living allowance granted under (a) of this subsection is a percentage increase of no less than the previous year's percentage increase in the consumer price index, CPI-U, for Seattle as published by the United States department of labor, bureau of labor statistics applied to that year's salary schedule as determined under chapter 41.06 RCW.  A decrease in the consumer price index is not applied.

    (c) The cost-of-living allowance for the year beginning July 1, 1998, is applied to the salary schedule in place on June 30, 1998.

    (2) If for any reason an omnibus appropriation bill or supplemental appropriation bill is not enacted, any annual cost-of-living allowance not funded by the legislature shall be calculated and included in the base salary for the purpose of calculating the annual increase for inclusion in the next enacted omnibus appropriation bill.
