     Declares that a person convicted of a felony offense that is committed for the benefit of, at the direction of, or in association with any criminal street gang, with the intent to promote, further, or assist in criminal conduct by gang members, shall, in addition and consecutive to the punishment prescribed for the felony or attempted felony of which he or she has been convicted, be punished by an additional term of one to three years at the court's discretion.

     Declares that a juvenile adjudicated of a felony offense that is committed for the benefit of, at the direction of, or in association with a criminal street gang, with the intent to promote, further, or assist in criminal conduct by gang members, must receive a sentence enhancement of ninety to one hundred twenty days confinement, at the discretion of the court.

     Provides that the act shall be null and void if appropriations are not approved.
