HB 1976 - DIGEST
Creates the Washington state school capital facilities board.
Requires the board to determine how the moneys in the excess real estate excise tax school capital construction account is to be divided among the state's school districts in order to provide local levy relief proportionate to the matching state funding to the districts.
Provides that all branches of government of this state, including state agencies, municipal and public corporations, and counties, may not require mitigation or impact fees, or both. All mitigation fees and impact fees are eliminated as of the effective date of this act.
Provides that the legislative authority of any county shall, if requested to do so by the school districts representing the majority of the students in the county, impose an additional excise tax on each sale of real property in the county at a rate of one hundred twenty-eight one-thousandths percent of the selling price. The proceeds of this tax shall be deposited in the excess real estate excise tax school capital construction account.
Provides that the proceeds of the additional excise taxes shall be used strictly for the following: The operation and preservation of roads, streets, and other transportation improvements; new construction, reconstruction, and expansion of city streets, county roads, and other transportation improvements; and planning, design, and acquisition of right of way and sites for such transportation purposes. The proceeds collected from excise taxes on the sale, distribution, or use of motor vehicle fuel and special fuel under this section shall be used exclusively for "highway purposes" as that term is construed in Article II, section 40 of the state Constitution.
Repeals RCW 39.92.040; 43.21C.065; 82.02.050; 82.02.060; 82.02.070; 82.02.080; 82.02.090; and 82.02.100.
