HB 2048 - DIGEST

 

     Provides that no application for benefits for occupational disease or infection is valid nor claim thereunder enforceable unless filed by a worker within two years following the date the worker knew or should have known that he or she has an occupational disease, except that an application for hearing loss must be filed within six months of the worker receiving information from a physician that he or she has suffered hearing loss and within five years of his or her last employment with an employer most likely to have caused the hearing loss.

     Provides that no application for benefits by a beneficiary of a worker suffering from an occupational disease is valid nor claim thereunder enforceable unless filed within two years from the date of death of the worker.
