SB 6057 - DIGEST

 

     Finds and declares that it is the policy of this state to assure that minor children have frequent and continuing contact with both parents regardless of the marital status of the minor child's parents.  In order to effectuate these important public policies, both parents should exercise the responsibility to make decisions and perform other parental functions necessary for the care and growth of their minor children.

     Declares that there shall be a presumption that joint residential placement is in the best interests of minor children unless:  (1) The parents have agreed to an award of residential placement to only one parent; or

     (2) the court finds, on the basis of clear, cogent, and convincing evidence, that joint residential placement would be detrimental to a particular child.
