(DIGEST OF PROPOSED 2ND SUBSTITUTE)

     Declares an intent, through an aquatic plant management permit program, to create a coordinated, timely, and predictable permit process that will assist property owners and local governments in controlling aquatic plants.

     Provides that no person may control, eradicate, remove, or otherwise alter any aquatic plants in waters of the state unless an aquatic plant management permit for such activity has been issued by the department, or unless:  (1) The removal is incidental or unintentional;

     (2) the activity removes noxious weeds with hand tools; or

     (3) the activity is in waters expressly exempted by this act or by rule.
