     On page 12, after line 11, strike lines 12 through 17 and insert:

AThis chapter applies to a charter public school as defined in section 2 of this act and to a charter public school=s employees, subject to the following conditions:

     (1) Any bargaining unit of employees of a charter public school may include only the employees of the charter public school unless the  charter public school board of directors and the exclusive bargaining representative of the charter public school employees agree otherwise;  and

     (2) The exclusive bargaining representative of a charter public school=s employees shall be the same as the exclusive bargaining representative of all other employees with similar skills and duties in the school district where the charter public school is located, if the district=s employees are represented by an exclusive bargaining representative.@

EFFECT:  Allows the bargaining unit of charter public school employees to include employees of other schools if the board of directors and the bargaining representative agree.  Makes the bargaining representative the same for charter school employees as other school district employees when the district=s employees are represented by an exclusive bargaining representative.
