On page 13, after line 4, insert the following:
ANEW SECTION. Sec. 21. A new section is added to chapter 41.32 RCW under subpart AProvisions applicable to plan I, plan II, and plan III" to read as follows:
(1) Charter public schools are employers and charter public school teachers are members under this chapter.
(2) This section takes effect only if the department of retirement systems receives determinations from the internal revenue service and the United States department of labor that such participation does not jeopardize the status of these retirement systems as governmental plans under the federal employees' retirement income security act and the internal revenue code.
(3) ACharter public school@ means the same as defined in section 2 of this act.
NEW SECTION. Sec. 22. A new section is added to chapter 41.35 RCW under subpart AProvisions applicable to plan II and plan III" to read as follows:
(1) Charter public schools are employers and charter public school employees other than teachers are members under this chapter.
(2) This section takes effect only if the department of retirement systems receives determinations from the internal revenue service and the United States department of labor that such participation does not jeopardize the status of these retirement systems as governmental plans under the federal employees' retirement income security act and the internal revenue code.
(3) ACharter public school@ means the same as defined in section 2 of this act.
(4) This section takes effect September 1, 2000.
NEW SECTION. Sec. 23. A new section is added to chapter 41.40 RCW under subpart AProvisions applicable to plan I and plan II" to read as follows:
(1) Charter public schools are employers and charter public school employees other than teachers are members under this chapter. RCW 41.40.750 applies to charter public school employees who are not in plan 1 under this chapter on September 1, 2000.
(2) This section takes effect only if the department of retirement systems receives determinations from the internal revenue service and the United States department of labor that such participation does not jeopardize the status of these retirement systems as governmental plans under the federal employees' retirement income security act and the internal revenue code.
(3) ACharter public school@ means the same as defined in section 2 of this act.@
Renumber remaining sections consecutively, correct internal references accordingly, and correct the title.
EFFECT: Makes technical changes to place provisions making charter public school employees part of the public retirement systems in the proper retirement system statutes. (Retains language making this designation contingent on authorization from the IRS and U.S. Department of Labor.)
