A(2) The department shall lease by an agreement, permit or other instrument use of state-owned aquatic lands at free market value for a cooperative association formed under chapter 23.86 RCW, a mutual corporation or association formed under chapter 24.06 RCW, or a public service company subject to regulation by the Washington utilities and transportation commission. If the department and the party seeking the lease, permit, or other instrument cannot reach agreement on the price of such lease, permit or other instrument, then the parties shall seek binding arbitration.

(3) From the effective date of this act forward, twenty-five percent of the increase in revenues to the department from this act shall be deposited into the common school construction account.

(4) On the effective date of this act, the department shall reduce by ten percent the amount used for administrative purposes from the aquatic lands account, based on the total percentage that the department currently spends for administrative purposes.

EFFECT: (1) Requires the Department of Natural Resources to charge free market price for the leasing of aquatic lands for public utility lines to a non-governmental entity; (2) Sends 25% of the increase in revenue to the common school construction account; (3) the Department of Natural Resources is required to reduce by ten percent the percentage of funds used from the aquatic lands account for administrative purposes.
