     On page 2, line 2, after Asection.@ insert AThis section shall not apply to the construction of any landfill which has received some or all of the required permits, or for which permit applications have been filed.@

EFFECT: Landfills which have received some or all of the permits required for their construction may be constructed in areas of the state that receive twelve or more inches of rain per year, based on the most recent 30-year average.
