    On page 3, line 3, after "use" insert ", and shall not include solid waste disposal facilities, unless the person seeking financial assistance under this chapter demonstrates sufficient financial capability in the form of a surety bond or other financial instrument available from the commencement of facility construction until the projected closure of the solid waste disposal facility, for site restoration should an unforeseen emergency event occur that results in a breach of integrity of the facility"

EFFECT: Provides financial assurance criteria for emergency response solid waste disposal facilities in order to be an eligible activity for WEDFA financing.
