    On page 2, after line 3, insert the following:

    "NEW SECTION. Sec. 2.  A new section is added to chapter 90.48 RCW to read as follows:

    In order to ensure that no property damage or personal injury will occur to nearby property owners or others who may be deprived of a remedy by the operation of section 1 of this act, the department shall set effluent limits and impose conditions in the issuance of water quality discharge permits for sources authorized in RCW 90.48.260(1) to insure that no damage will result from a discharge or activity permitted under this chapter.

NEW SECTION. Sec. 3.  A new section is added to chapter 70.94 RCW to read as follows:

    In order to ensure that no property damage or personal injury will occur to nearby property owners or others who may be deprived of a remedy by the operation of section 1 of this act, the department shall set emission limits and impose conditions in the issuance of air quality permits for stationary sources to ensure that no damage will result from an emission or activity permitted under this chapter.

NEW SECTION. Sec. 4.  A new section is added to chapter 70.95 RCW to read as follows:

    In order to ensure that no property damage or personal injury will occur to nearby property owners or others who may be deprived of a remedy by the operation of section 1 of this act, the department shall set discharge limits and impose conditions in the issuance of permits for solid waste handling facilities, including landfills, to ensure that no damage will result from a discharge or activity permitted under this chapter.

NEW SECTION. Sec. 5.  A new section is added to chapter 35.21 RCW to read as follows:    In order to ensure that no property damage or personal injury will occur to nearby property owners or others who may be deprived of a remedy by the operation of section 1 of this act, a city issuing an approval for a development which includes stormwater discharge conditions shall set such discharge conditions to insure that no damage to adjacent or downgradient property will result from discharges permitted under the approval.

NEW SECTION. Sec. 6.  A new section is added to chapter 36.70 RCW to read as follows:

    In order to ensure that no property damage or personal injury will occur to nearby property owners or others who may be deprived of a remedy by the operation of section 1 of this act, a county issuing an approval for a development which includes stormwater discharge conditions shall set such discharge conditions to ensure that no damage to adjacent or downgradient property will result from discharges permitted under the approval.

NEW SECTION. Sec. 7.  A new section is added to chapter 43.21A RCW to read as follows:

    In order to ensure that no property damage or personal injury will occur to nearby property owners or others who may be deprived of a remedy by the operation of section 1 of this act, the department in issuing an approval for a development which includes stormwater discharge conditions shall set such discharge conditions to ensure that no damage to adjacent or downgradient property will result from discharges permitted under the approval."
