                          RULED OUT OF ORDER AS 2^ND STRIKER 3/17/99

    Strike everything after the enacting clause and insert the following:

    "NEW SECTION. Sec. 1. The department of ecology shall conduct a study of the need for financial liability requirements for owners and operators of landfills permitted under chapter 70.95 RCW.  The department shall consider the need for special requirements on above-ground landfills that exceed one hundred acres with a horizontal height of at least one hundred feet.  In its consideration, the department shall examine what financial assurance other states require for such facilities.

    The Department shall report its findings to the legislature by December 31, 1999."

    On page 1, line 2 of the title, after "landfills;" strike the remainder of the title, and insert "and creating a new section."
