    On page 12, after line 6, strike all material on lines 7 and 8 and insert the following:

"(1) Within available funds, the department shall ensure that all new highway construction is compatible with the use by single-occupant vehicles of high occupancy vehicle lanes during the non-peak hours of 9:00 a.m. to 3:30 p.m. and 7:00 p.m. to 5:00 a.m.  If new construction must be improved to accommodate this non-peak high occupancy vehicle lane use."

    Renumber the sections consecutively and correct any internal references accordingly.
