Title:  An act relating to partial confinement in sentences of one year or less.

Majority Report:  That Substitute Senate Bill No. 6397 be substituted therefor, and the substitute bill do pass.

Background:  Alternatives to total confinement are available for offenders sentenced to terms of one year or less.  Under current law, a term of partial confinement may be substituted on a day for day basis with a term of full confinement.

 

Summary of Substitute Bill:  The Governor must personally testify before a committee that is hearing a Governor request bill.

 

At least one day and up to two days of partial confinement may be substituted for one day of total confinement.

 

Substitute Bill Compared to Original Bill:  The substitute retains the day for day substitution in current law as a minimum.  It also requires the Governor to personally testify on when Governor request legislation is being heard in committee.

 

Appropriation:  None.

 

Fiscal Note:  Requested on January 17, 2000.

 

Effective Date:  Ninety days after adjournment of session in which bill is passed.

 

Testimony For:  It provides courts more flexibility to use partial confinement alternatives.  This may assist to ease jail overcrowding.
