Providing a limited exemption from the substantial development provisions of the shoreline management act for motion picture production.


    AN ACT Relating to the temporary development of shorelines; and adding a new section to chapter 90.58 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 90.58 RCW to read as follows:

    A person who uses a shoreline location for the production of motion pictures is exempt from the substantial development provisions of this chapter if all of the following apply:

    (1) The motion picture project does not interfere with the normal public use of surface waters;

    (2) The project will have no significant adverse impact on the environment including, but not limited to fish, wildlife, fish or wildlife habitat, water quality, and aesthetic values;

    (3) Notice is provided to the local government before the start of a motion picture project that a shoreline location is intended for such use, and that such use shall be for a period of one year or less;

    (4) An assessment is provided to the local government, before the start of a motion picture project, of the vegetation, land configurations, and other conditions to which the intended shoreline location will be restored upon completion of the project; and

    (5) A performance bond or other evidence of financial responsibility is provided to the local government before the start of a motion picture project to ensure that the site is returned to the condition assessed in subsection (4) of this section, or to an improved condition.  Evidence of financial assurance shall be provided within three weeks of providing notice to the local government.
