Imposing a penalty for state agencies that fail to meet legislative reporting requirements.


    AN ACT Relating to reports to the legislature; adding a new section to chapter 44.04 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 44.04 RCW to read as follows:

    If a state agency has a legislatively mandated requirement to report to the legislature or legislative committees regarding a specific matter by a date certain and the agency either fails to report to the legislature by the specified time or provides a report that is insufficiently responsive to the legislation requiring the report, the legislature, by concurrent resolution, shall impose a one hundred thousand dollar penalty.  The resolution shall:  Provide notice to the agency of the penalty; specify that the penalty shall be paid from the agency's administrative budget to the general fund; and cite the legislative authority for the report and details regarding the report's untimeliness or unresponsiveness.
