HB 1178 - DIGEST

(SUBSTITUTED FOR - SEE 1ST SUB)

     Provides that sex offender examinations and treatment ordered as a special condition of community placement or community custody under this act shall be conducted only by sex offender treatment providers certified by the department of health under chapter 18.155 RCW unless the court finds that:  (1) The offender has already moved to another state or plans to move to another state for reasons other than circumventing the certification requirements;

     (2) no certified providers are available for treatment within a reasonable geographic distance of the offender's home; and

     (3) the evaluation and treatment plan comply with the rules adopted by the department of health.
