(DIGEST OF PROPOSED 1ST SUBSTITUTE)

     Provides that a governmental entity seeking to treat not more than twenty percent of the littoral zone of a lake infested with Eurasian water milfoil may use the pesticide 2,4-D to treat the Eurasian milfoil infestation without obtaining a permit under RCW 90.48.445.

     Provides that, before applying 2,4-D, the government entity shall provide twenty-one days' notice to the department of ecology, the department of fish and wildlife, the department of agriculture, and the department of health, notify all lake residents, post notices of the intent to treat weeds at all public access points before making such treatment, and place informational buoys around the treatment area.

     Makes an appropriation of one hundred seventy-five thousand dollars for the fiscal year ending June 30, 2000, from the general fund to the department of ecology for the purposes of the Eurasian milfoil projects.  Up to three percent of the total amount may be used by the department to cover administrative costs.

     Makes an appropriation of one hundred seventy-five thousand dollars for the fiscal year ending June 30, 2001, from the general fund to the department of ecology for the purposes of the Eurasian milfoil projects.  Up to three percent of the total amount may be used by the department to cover administrative costs.
