SB 5809 - DIGEST

     Directs the department to prohibit the sale or use of commercial fertilizers or soil amendments that contain any solid waste as defined in RCW 70.95.030, hazardous waste, by-products, or co-products, resulting from an industrial process that may create or release dioxin.

     Requires any person in Washington state generating a solid waste, hazardous waste, by-product, or co-product resulting from an industrial process that may create or release dioxin to report annually to the department if such wastes, by-products, or co-products can be used for the purposes of commercial fertilizer or soil amendments.

     Requires any person importing to Washington state a solid waste, hazardous waste, by-product, or co-product resulting from an industrial process that may create or release dioxin to report annually to the department if such wastes, by-products, or co-products can be used for the purposes of commercial fertilizer or soil amendments.

     Declares that the department has the authority to immediately stop the sale or use of any commercial fertilizer or soil amendment which is made from, contains, or is a solid waste, hazardous waste, by-product, or co-product resulting from an industrial process that may create or release dioxin.
