     On page 2, line 2, after Acosts.@ insert AHowever, any costs associated with the upgrade of any existing utility facility that the utility elects to undertake must be paid by the utility.@

EFFECT:  Clarifies that utilities are not responsible for the costs of relocation of utility facilities as a result of construction, repair, or improvement of a regional transit authority system but are responsible for the costs associated with the upgrade of existing facilities that the utility elects to undertake.
