     On page 24, beginning on line 15, strike section 35, and insert:

ANEW SECTION. Sec. 35.  If section 28 or its application to any person or circumstance is held invalid, the entire act is null and void.@

EFFECT:  The entire act is null and void if the section is held invalid that provides for the group that may adopt a rule providing for votes by undeclared voters to be used to determine a major party's nominees, is composed of: (1) State officials who were elected as members of that party; (2) legislators who were elected as members of that party; and (3) the state central committee of that party.
