     On page 2, line 12, after A(2)(a)@ insert AThe petitioner seeking visitation shall submit together with a petition, an affidavit setting forth facts supporting the requested order and shall give notice, together with a copy of the affidavit, to the parents of the child and any other persons with an order of custody, who may file opposing affidavits.  The court shall dismiss the petition unless it finds that adequate cause for hearing the petition is established by the affidavits, in which case it shall set a date for hearing on the petition.

Renumber the remaining subsection accordingly.

 

 

 


 

EFFECT: Adds procedures to clarify how the court makes the initial threshold determination on a petition for visitation.  The person seeking visitation must file a petition with affidavits and serve notice on the opposing party.  The court shall dismiss the petition unless it finds that adequate cause exists for a hearing on the petition.
