     On page 2, line 9 of the amendment, after "costs." insert the following:

     "Civil damages may be offset by amounts expended by the employer on promotions, including televised advertising or other forms of mass distribution, using the employee's name, voice, physical image, or representation thereof.  These amounts will be calculated according to the fair market value of the employee's share of promotions televised or otherwise distributed during the period of the contract."

EFFECT:  Permits offsets against civil damages for amounts expended by the employer to promote the employee.
