     Beginning on page 1, line 17, after "required;" strike all material through "laws" on page 2, line 7, and insert "and

     (2) Whether the bidder has demonstrated the ability to perform the contract within the time specified"

EFFECT: Removes from consideration by government entities when determining whether the lowest responsive bidder is responsible, the bidder's experience, whether the bidder has historically demonstrated the ability to perform the contract within the time specified, the bidder's satisfactory completion of previous contracts or services, and the bidder's previous and current compliance with contracting laws.  Government entities must consider the ability, capacity, and skill of the bidder to perform the contract or provide the service required, and must consider whether the bidder has demonstrated the ability to perform the contract within the time specified.
