Strike everything after the enacting clause and insert the following:
"Sec. 1. RCW 70.46.060 and 1993 c 492 s 248 are each amended to read as follows:
(1) The district board of health shall constitute the local board of health for all the territory included in the health district, and shall supersede and exercise all the powers and perform all the duties by law vested in the county board of health of any county included in the health district.
(2) The district board of health may impose civil penalties of up to one hundred dollars per day for violations of any public health statute, rule, or regulation, relating to environmental health, including local rules, regulations, and ordinances, as follows:
(a) Prior to imposing a civil penalty, the district board of health shall provide notice in writing to the person in violation, describing the violation and the penalty process. The person in violation shall be given a reasonable opportunity to comply with the public health statute, rule, or regulation.
(b) If the violation remains, the district board of health may impose a civil penalty by providing notice in writing to the person incurring the penalty.
(c) Any penalty imposed under this section may be appealed to the district board of health.
(3) For purposes of this section, "environmental health" means those aspects of human health that are or can be affected by contaminants or changes in the environment, including but not limited to food safety, drinking water, on-site sewage disposal, and waste disposal.
(4) The district board of health shall adopt local ordinances implementing the provisions of this section."

On page 1, line 2 of the title, after "districts;" strike the remainder of the title and insert "amending RCW 70.46.060; and prescribing penalties."
EFFECT: Clarifies that the bill applies to district boards of health and establishes a procedure to be used when imposing a civil penalty.
