ESHB 2518 - S COMM AMD

    Strike everything after the enacting clause and insert the following:

    "NEW SECTION. Sec. 1.  A new section is added to chapter 70.46 RCW to read as follows:

    (1) Health districts may impose civil penalties for violations of any public health statute, rule, or regulation, including local rules, regulations, and ordinances, as follows:

    (a) Prior to imposing a civil penalty, a health district shall provide notice in writing to the person in violation, describing the violation and the penalty process.  The person in violation shall be given a reasonable opportunity to comply with the public health statute, rule, or regulation.

    (b) If the violation remains, the health district may impose a civil penalty by providing notice in writing to the person incurring the penalty.

    (c) Any penalty imposed under this section may be appealed to the health district board.

    (2) All health districts shall adopt local ordinances implementing the provisions of this section."

    On page 1, line 2 of the title, after "districts;" strike the remainder of the title and insert "adding a new section to chapter 70.46 RCW; and prescribing penalties."

EFFECT:  Clarifies that the bill applies to health districts and establishes a procedure to be used when imposing a civil penalty.
