    On page 6, after line 4, insert the following:

    "(4) Prior to the director releasing a product's confidential statement of formula pursuant to this section, the director shall notify the applicant or registrant of the product that is proposed to be used by the department.  The notice shall provide the applicant or registrant of the product an opportunity to approve or object to the release of the product's confidential statement of formula that would be involved in the consultation process under this section.  If within fifteen calendar days of receipt of notice, the applicant or registrant notifies the department and objects to the release of the confidential statement of formula, the department shall not release the confidential statement of formula and the department shall have the option of selecting another product."

    Renumber the sections consecutively and correct any internal references accordingly.

EFFECT: Allows a registrant of a pesticide product proposed to be used by the department of agriculture to reject disclosure of confidential data by the department.  If a rejection is made, the department may choose not to use the product.
